Terms & Conditions – Layover Ehf.

Introduction

We are not an algorithm or a faceless booking engine. Layover is a curated collection of Iceland's finest experiences.

We partner with experienced, often family‑owned Icelandic tour operators who have spent decades mastering their craft. We build real relationships with our partners and select them for their quality, character, and professional track record.

By booking through Layover, you support a network of trusted local experts.

This introduction is descriptive only and does not form part of these Terms.

To ensure clarity and transparency for all parties, the following Terms & Conditions govern your booking.


Terms and Conditions

These Terms & Conditions ("Terms") govern all bookings made through Layover Ehf. ("Layover," "we," "our," "us"). By purchasing a tour or activity ("Service") through our website, you ("the client") agree to be legally bound by these Terms.

Layover Ehf. operates solely as an intermediary and commercial agent for independent, licensed Icelandic tour operators ("Operators").


1.1 Layover Ehf. acts exclusively as an agent on behalf of Operators. Where Layover Ehf. acts as the direct operator of a Service, this will be clearly stated on the Service description and booking confirmation.

1.2 When a booking is made, the contractual relationship for the performance of the Service is established directly between the client and the Operator.

1.3 Layover Ehf. is not responsible for the performance, execution, safety, quality, timing, or delivery of any Service, except to the extent required by mandatory Icelandic or EU consumer protection law. All operational responsibilities and insurance obligations rest with the Operator.

1.4 Layover Ehf. does not own or control Service inventory. Payments are received by Layover Ehf. as agent on behalf of the Operator and transferred in accordance with agreed settlement terms.


2. Booking and Payment

2.1 All bookings must be made through Layover's online platform.

2.2 Full payment is required at the time of booking unless otherwise stated.

2.3 Prices are listed in Icelandic króna (ISK). VAT is applied where required under Icelandic tax law. Certain Services may be VAT‑exempt depending on the nature of the activity.

2.4 Layover reserves the right to correct pricing errors, update pricing based on Operator changes, and amend displayed information in the event of inaccuracies.

2.5 Agency & Service Fees. The total price paid includes the Operator's rate for the Service and a service fee retained by Layover Ehf. for the administration and curation of the booking. Layover Ehf. collects payment on behalf of the Operator. Retention of this fee does not affect the Operator's responsibility for delivery of the Service.


3. Booking Confirmation

3.1 Upon successful payment, a booking confirmation will be sent to the email address provided by the client.

3.2 The client is responsible for reviewing all booking details, including dates, times, locations, participant numbers, and Service descriptions.

3.3 Any discrepancies must be reported to Layover promptly.

3.4 Operator Identification. Layover partners with multiple verified Operators. By completing a booking, you consent to the Operator being identified after purchase and acknowledge Layover's role as an intermediary. The Operator's name and contact details will be provided on the booking confirmation and voucher immediately after payment.


4. Cancellation and Refund Policy

4.1 Cancellations made more than 24 hours before the scheduled departure time are eligible for a full refund. Different cancellation policies may apply to private tours, multi‑day tours, or group bookings; where stated, the Operator's specific policy takes precedence.

4.2 No refunds are issued for:

  • Cancellations within 24 hours of departure;
  • Bookings made within 24 hours of departure;
  • No‑shows or late arrivals;
  • Missed Services due to flights or transportation not provided by the Operator.

4.3 Refund requests must be submitted in writing. Refunds are processed without undue delay and no later than 7 business days after approval. Partial refunds for unused portions of a Service are not available.

4.4 In accordance with Article 16(l) of Directive 2011/83/EU, the statutory 14‑day right of withdrawal does not apply to leisure services provided on a specific date or within a specific period.


5. Cancellations or Modifications by the Operator

5.1 Operators may cancel or modify a Service due to weather conditions, safety concerns, insufficient participation, operational limitations, or other circumstances beyond their control.

5.2 In the event of an Operator‑initiated cancellation, the client will be offered either a full refund or an alternative date or comparable Service, subject to availability.

5.3 Refunds shall not exceed the total amount paid for the cancelled Service.

5.4 Layover bears no responsibility for consequential losses, including accommodation, transportation, missed flights, or other related expenses.


6. Client Responsibilities

6.1 Clients must arrive on time at the designated meeting point with appropriate clothing, equipment, and documentation as specified in the Service description.

6.2 Clients must follow all instructions issued by the Operator or guide.

6.3 Clients are responsible for assessing their own physical fitness and medical suitability. Operators may require disclosure of relevant medical conditions where safety is concerned.

6.4 Operators may refuse participation without refund if a client is deemed unfit, unprepared, disruptive, or unable to participate safely.


7. Liability and Inventory

7.1 To the maximum extent permitted by law, Layover Ehf. is not liable for any accident, injury, loss, damage, delay, inconvenience, or expense arising from participation in a Service. All liability associated with delivery and execution lies with the Operator.

7.2 Layover is not responsible for inaccuracies or omissions in Service information supplied by Operators.

7.3 Inventory Control. Availability, scheduling, and capacity are determined solely by the Operator. Layover does not pre‑purchase or hold inventory and cannot guarantee availability until confirmed by the Operator. If a booking request is rejected, Layover's liability is limited to a full refund of the amount paid.


8. Guide & Operator Substitution

Layover curates experiences based on the high quality of our local operators and specific guides. However, due to illness, emergency, or unforeseen operational realities, an operator may occasionally need to substitute a named guide. In these rare events, the operator commits to providing a fully qualified, hand-picked local professional who upholds the exact standards and spirit of the original experience. Guide substitution does not constitute grounds for a refund or cancellation.


9. Travel Insurance

9.1 Clients are strongly advised to obtain comprehensive travel insurance covering medical expenses, cancellations, delays, personal property, and activity‑related risks.

9.2 Layover does not provide or sell insurance services.


10. Privacy and Data Protection

10.1 Layover processes personal data solely for booking and communication purposes.

10.2 Necessary personal information is shared with the relevant Operator to fulfil the booking.

10.3 Data is handled in accordance with GDPR and the Icelandic Data Protection Act No. 90/2018. Further details are available in Layover's Privacy Policy, which forms an integral part of these Terms.


11. Force Majeure

Neither Layover nor Operators are liable for failure to perform obligations due to events beyond reasonable control, including extreme weather, natural disasters, strikes, or government actions. Such events do not automatically entitle the client to compensation beyond refunds expressly stated in these Terms.


12. Complaints

12.1 Complaints regarding the execution of a Service must be raised with the Operator immediately and within a reasonable time after the incident.

12.2 Layover may assist with communication but has no authority to determine liability or issue refunds outside these Terms.

12.3 If a complaint cannot be resolved, you may contact the Icelandic Consumer Agency (Neytendastofa) at neytendastofa.is.


13. Governing Law and Jurisdiction

13.1 These Terms are governed exclusively by Icelandic law.

13.2 Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of Icelandic courts.


14. General Provisions

14.1 Amendments. Layover Ehf. may amend these Terms at any time. The Terms in force at the time of booking apply to that booking.

14.2 Severability. If any provision is held invalid or unenforceable, the remaining provisions remain in full force.

14.3 Assignment. Layover Ehf. may assign its rights and obligations under these Terms as part of a corporate restructuring or sale.

14.4 Age and Capacity. The client confirms they are at least 18 years old and have legal capacity to enter into this contract, or are acting with proper authority on behalf of all participants.
